terms and conditions

  • This agreement starts when you indicate to us your acceptance by either signing online or in the gym.

  • This agreement is binding between you and us when we contact you to confirm your membership application has been accepted, when your payment transaction (as the form of consideration) has been processed, a contract will come into existence between you and us.

  • You will be entitled to all the rights and privileges set for the membership you have agreed to pay for.

  • You cannot transfer this agreement to anyone else.

  • If any Direct Debit seen as unpaid or if any other form of payment is offered for any reason, even if we have notified you of a missed payment, further payments are missed, we have the right to, at our discretion, either suspend or terminate your membership, after having given you written notification to do so.

  • You agree to notify us quickly of any changes to your Members Details provided.

  • First month's membership fees are collected from you by us either by Debit / Credit card at time of purchase, or by Direct Debit approximately 7 working days from your membership application date.

  • As a member your next Direct Debit for the rolling membership fees will be collected one month after joining. Following Direct Debits for monthly membership fees will be collected monthly thereafter. Each payment made is not refundable under any circumstances.

  • Notice of 25 days is required before cancelling your membership as a 'Monthly' membership holder. A 'Monthly' membership is 2 month minimum contract, so members can only cancel after 2 months of being a member of Bromley Fitness Centre.

  • There may be occasions where we have to close all, or part of, the gym of which you are a member. We will try our best to let you know of these closures in advance of the closures, unless the problem is very pressing or an emergency. You will not be entitled to any refund of your membership fees in such circumstances, we will consider potential refunds depending on the circumstances.

  • We will not be liable or responsible for any in compliance of contract terms, or interruption in performance of, any of our duties under these terms that is instigated by any incident that is outside of our control, unless we have a duty of care to do so.

  • We will not be liable or responsible for unsettled payments paid to a Personal Trainer. Personal Training is arranged directly and independently with the PT and not with Bromley Fitness Centre LTD..

  • This agreement is administrated by English Law.

  • We may conclude this agreement with immediate effect after contract you if you have breached the gym restriction and etiquettes .

  • Members must be 16 or older. All staff members can ask members or non-members for ID, and can refuse entry if valid ID (passport & driving license) is not provided.

  • Agreement to comply with the restrictions in and around the gym, either due to Covid-19 or other reasons, which relate to opening times, facility use and your behaviour. We might make reasonable changes to these restrictions at any time, we will give you advance notice of these changes.

  • If we take no action or let you off any break of this agreement or give you extra time to reimburse or comply, it will not stop us enforcing the terms of this agreement strictly at a future date.

  • To the best of your knowledge and confidence you are in good health and not knowingly incompetent of engaging in either active or passive exercise and  it would not be harmful to your health, safety, comfort, wellbeing or physical condition. Further, that you will tell us instantly if your circumstances change.

  • You can terminate your membership at any time allowing. Allow us 25 days including the bank’s direct debit processing time to cancel the membership. Please contact us if you need more information about specific circumstances.

  • Overdue payments will be taken via card or direct debit automatically.

  • Direct Debit cancellations with your bank do not act as a termination of your membership. Cancellations of memberships can be processed by Emailing info@bromleyfitnesscentre.com to confirm your request for membership termination. Email address and the postcode linked to the said membership requesting to be cancelled must be noted in the email.

  • If you fail to pay any membership fee or any other fee due under this Agreement on the date such fee is due, you agrees to pay a late payment fee of £5 for each such failure. The late payment fee shall be payable within 14 days of the due date of the fee. The Gym will suspend the Member’s access to the Gym facilities until all fees and late payment fees are paid in full. This clause is intended to be fair and reasonable under the Consumer Rights Act 2015 and the Unfair Terms in Consumer Contracts Regulations 1999

  • No refunds are entitled to be paid if you have not terminated your membership by contacting us within the 25 day notice period.

  • As per the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you are entitled to cancel your membership and receive a full refund of any fees paid within 14 days of completing your membership application form. However, as per regulation 36 of Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you select to start your membership immediately, you agree that if you later cancel your membership within the 14 day period, you will be refunded any payment paid, minus an amount for the membership you have already used that starts from the first day after joining.

We will use your personal information to offer you with the services, products or information that you have requested, for administration reasons, to improve your experience, and marketing. We may need to share your information with our service providers, accompanying organisations and agents for these purposes. We may use your information to:

 

  • Identity checks are a part of your membership application. This is carried out by an independent company, ask a member of staff for more details.

  • Bill you for using our services as part of your membership.

  • Keep you informed about our services including working matters relating to your Membership

  • Confirm your attendance to exercise classes or lessons.

  • Contact you with offers or promotions based on our assessment of how you use our services and what we think will be of interest to you (you choose not to receive our marketing messages).

  • Respond to any questions or concerns you might have about our services.

  • Understand how you use our services, to help us develop relevant and updated services.

  • Carry out quantitative and qualitative research to monitor how customers use our services.

  • Prevent and detect fraud or other criminalities.

 

Where we process your personal data based on your consent you have the right to withdraw consent at any time. If you no longer want to be contacted by us, whether it is marketing emails you do not want to receive or when cancelling your membership you do not want membership surveys or updates from, please contact us via our email, info@bromleyfitnesscentre.com. You can choose to opt out of all marketing or select your marketing preferences.

We’ll store your information for as long as you are a member of Bromley Fitness Centre, or following cancellation and to meet legal requirements including financial audit, anti-fraud and money laundering regulations we will store your information for no more than 6 years from the last activity on the account.
